Terms and Conditions

Article 1: Definitions

1.      Marigold & Pea; Marigold & Pea, established in Rotterdam, the Netherlands.

2.      Customer: the party which Marigold & Pea has entered into an agreement with.

3.      Parties: Marigold & Pea and the customer together.

Article 2: Online Store Terms

These terms and conditions will apply to all orders, agreements, and deliveries of services or products by or on behalf of Marigold & Pea. By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal, unauthorized purpose, duplicate, copy nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
A breach or violation of any of the Terms will result in an immediate termination of your order.

 

Article 3: Prices & Product

  1. The customer must pay the full amount.

  2. All prices used by Marigold & Pea are in euros, and are exclusive of VAT, and of any other costs such as administration costs, shipping, or transport expenses unless expressly stated otherwise or agreed otherwise.

  3. Marigold & Pea is entitled to adjust all prices for its products on its website at any time. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

  4. We shall not be liable to a customer or to any third-party for any modification, price change suspension or discontinuance of the Service.

  5. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

  6. All prices are subject to typographical and printing errors. No liability is accepted for the consequences of typographical and printing errors. In the event of typographical and printing errors, Marigold and Pea is not obliged to deliver the product at the incorrect price.

  7. We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

  8. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.


Sample/ Models:
If the customer has received a sample or model of a product, he cannot derive any rights this other than that it is an indication of the nature of the product.

Article 4: Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

The customer is obligated to furnish up-to-date, comprehensive, and precise purchase and account information for any transactions conducted at our establishment. The customer is required to promptly update their account and other pertinent information, such as their email address, credit card numbers, and expiration dates.

Article 5: Right of withdrawal

When purchasing products, the consumer has the opportunity to terminate the agreement without specifying reasons within 14 days

  • A consumer may cancel an online purchase during a cooling-off period of 14 days without giving any reason provided that:

  • The product has not been used.

  • It is not a product that may not be returned for hygiene reasons.

  • The seal is still intact.

 

 

  • The cooling-off period of 14 days as referred to in paragraph 1 commences:

  • On the day after the customer has received the last product of part of 1 order.

 

  • The consumer can notify his right of withdrawal via support@marigoldandpea.com if desired by using the withdrawal form that can be downloaded via the website Marigold & Pea, Marigoldandpea.com

  • The consumer is obligated to return to Marigold & Pea within 14 days after the notification of his right of withdrawal, after which period his right of withdrawal will lapse.

 

  • During the cooling-off period, the consumer will carefully handle the product and packaging. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he decides to utilize withdrawal, he will return the unused and undamaged product with all accessories and - if reasonably possible - in the original shipping packaging to Marigold & Pea.

 

Article 6: Reimbursement of return costs

If the consumer invokes his right of withdrawal and returns the entire order on time, the costs for returning the complete order will be borne by the consumer.

If the consumer has made a payment, Marigold & Pea will refund this amount as soon as possible but no later than 14 days after the withdrawal, provided that the product has been received by the online retailer or conclusive evidence of complete return has been provided. The refund will be made using the same payment method used by the consumer unless the consumer expressly consents to another payment method.

In cases where the product is damaged due to careless handling by the consumer, the consumer is liable for any decrease in the product's value.

The consumer cannot be held liable for a decrease in the product's value if the Marigold and Pea has not provided all legally required information about the right of withdrawal, which must be done before the conclusion of the sales agreement.

Items on sale aren’t eligible for refunds

Delivery

1.      Delivery takes place while stocks last.

2.      Delivery takes place at customer house, unless the parties have agreed otherwise.

3.      Delivery of products ordered online takes place at the address indicated by the customer.

​

 

Delivery Period

The delivery starts once the customer has fully completed the (electronic) ordering process and received an (electronic) confirmation of his order from Marigold & Pea.

 

Delivery costs

Delivery costs are paid by the customer unless the parties have agreed otherwise.

 

Packaging and shipping

  • If the package of a delivered product is opened or damaged, the customer must have a note drawn up by the forwarder or delivery person before receiving the product. In the absence of this, Marigold & Pea may not be held liable for any damage.

 

  • If the customer himself takes care of the transport of a product, he must report any visible damage to products or the packaging prior to the transport to Marigold and Pea, failing which Marigold & Pea cannot be held liable for any damage.

 

As soon as the purchased item has been received by the buyer, the risk passes from seller to buyer.

Complaints

  1. The customer must examine a product provided by Marigold & Pea as soon as possible for possible shortcomings.

  2. The customer gives a detailed description as possible of the shortcomings so that Marigold & Pea can respond adequately.

  3. Complaints regarding damage or loss of delivered goods must be submitted in writing to the seller by the buyer within 10 working days after the day of delivery of the goods. The customer can email Marigold & Pea, support@marigoldandpea.com

 

Liability of Marigold & Pea

  1. Marigold & Pea shall be held liable solely in the event of a Defective Product. This encompasses any flaw in the candle's design, manufacturing process that directly results in harm to the consumer.

 

Changes in the general terms and conditions

  1. Marigold & Pea is entitled to amend or supplement these general terms and conditions.

  2. Changes of minor importance can be made at any time.

  3. All brands, images, texts, comments, illustrations (animated) images, video images, sounds, and all the technical applications that can be used to operate this website, and more generally all the components used on this website, are protected by the laws on intellectual property. Any reproduction, repetition, use, or modification, by any means whatsoever, of all or just part of it, including technical applications, without the prior written permission of the controller, is strictly prohibited. The fact that the controller may not take immediate action against any infringement, cannot be considered as tacit consent, nor of a waiver of any right to prosecute the infringing party.
